"How would you shut it down?" The examiner's question about AI agents has arrived, and it has your name on it

On Tuesday, Reuters reported that US bank examiners are asking how AI agents are limited, approved, audited and shut down. This morning, the Financial Stability Board finalized 12 sound practices that put AI oversight on the board and senior management. There are still no prescriptive rules, so every answer your firm gives is a judgment call that someone signs. This edition gives you the questions, the evidence to have ready, and a 2-minute self-check.

Written for one reader

Chief Compliance Officer or General Counsel at a bank, insurer, health system or utility.
Top-of-mind question: "If an examiner asks this quarter how we limit, audit and stop our AI agents, what evidence do I hand over, and whose name is on it?"

2. Lead: examiners and the FSB converge on "stop, approve, prove"

What happened (Tuesday, October 13). Reuters reported, citing people familiar with the matter, that examiners at the Federal Reserve, the OCC and the FDIC are asking large, mid-size and small banks how AI agents are limited, monitored and approved, whether agent decisions can be audited, whether humans stay in key decisions, and how autonomous systems would be shut down. Examiners are also asking whether banks use Chinese-developed models and whether they use AI agents for cyber defense. Supervisors "have not established prescriptive requirements," the report said, and the agencies did not comment. CITED C01

What happened (Thursday, October 15). The Financial Stability Board published its final report on sound practices for the responsible adoption of AI: 12 practices in two groups. The first group is organization-wide governance (board and senior-management oversight, defined roles, AI in the risk framework, continuous learning). The second covers the AI lifecycle (materiality, technology selection, data, explainability, performance evaluation, human oversight, cyber and ICT risk, third-party dependencies). VERIFIED C02 Reuters reported that the final text strengthens the June draft on agents: firms should set clear, risk-based triggers for when an agent must seek human approval, and the FSB dropped the "synthetic employees" framing because "AI agents do not reason like humans and may interpret pre-defined goals in unexpected ways." CITED C03

Europe moves on recovery. According to the same Reuters reporting, the ECB gave significant banks until October 31 to submit plans against AI-enabled cyberattacks, including mapping AI use and third-party dependencies and showing they can switch systems off and restart them in a controlled way. The Bank of England is encouraging the largest banks to test "bare metal" recovery. CITED C04

Our read (opinion)

Three supervisors, one week, one shared test: can you stop an agent, show who approved its authority, and prove what it did? The Fed's April 17 revised model risk guidance (SR 26-2) is the current supervisory baseline for models VERIFIED C40; the questions reported this week go further, into agent actions and shutdown. Firms that answer with evidence, not policy text, will set the bar their peers are measured against.

JPMorgan Chase (Oct 13)Dimon: "you do not want rogue agents, and there could be thousands of them"; the bank will not allow "just any… outside agent" inside. VERIFIED C05A peer has publicly drawn a perimeter for outside agents. Expect examiners to ask whether you have one.
Citi (Oct 13)CEO Jane Fraser said AI is helping build products "up to 40% faster" and coding tools cut tech vendor expenses by 30%. CITED C06Productivity claims will be tested against the controls that make them safe.
Wells Fargo (Oct 14)Headcount down 8% year over year; CEO Charlie Scharf called the AI build-out "a complicated macroeconomic force." CITED C06Workforce changes tied to AI draw their own scrutiny (see section 13).
