Macro Signal: EU AI Act Omnibus Reaches Final Adoption
What was "provisional" a month ago is now a formality away from law

The story enterprises have been watching since May just moved from political agreement to near-certainty. On June 29, 2026, the Council of the EU gave its final green light to the AI Act simplification package, following the European Parliament's formal endorsement on June 16, 2026. The amendments now await publication in the EU's Official Journal, expected before August 2, with entry into force three days after. This is materially different from the "provisional trilogue agreement" framing used through most of June. It is no longer a proposal in progress.

What the Digital Omnibus Actually Changes
Article 50 — Transparency

Unchanged. 29 days from today. Disclosure obligations for GPAI providers and user-facing AI interactions were not deferred by the Omnibus. Watermarking under Article 50(2) gets a four-month grace period to December 2, 2026 for systems already on the market before August 2.
Annex III — High-Risk Standalone AI
Dec 2, 2027
Now essentially locked in. Stand-alone high-risk AI systems (credit scoring, hiring, clinical decision support) move from August 2026 to December 2027. Embedded high-risk AI in regulated products (Annex I) shifts further, to August 2, 2028.
New Prohibition Added to Article 5
Effective on entry into force
The Omnibus package also inserts a new prohibition into Article 5 banning AI systems that generate non-consensual intimate imagery ("nudifiers") and AI-generated child sexual abuse material — a targeted addition separate from the high-risk timeline debate.
Platform Momentum Did Not Wait for the Legal Text
Guggenheim upgraded both Salesforce and ServiceNow to Buy on July 1, arguing that fears of AI cannibalizing SaaS revenue are overstated. Salesforce disclosed Agentforce ARR at $800M, up 169% year-over-year, and shipped Agentforce Help Agent (pay-per-resolution pricing, GA this month) plus an Agentforce Commerce integration with ChatGPT. Anthropic shipped Claude Sonnet 5 as the new default for Free and Pro users and introduced a Claude Apps Gateway for Bedrock and Google Cloud with SSO, role-based access, and spend caps — a governance-relevant control plane, not just a model release.

FINRA wants governance rigor. Agentic tools want autonomy. Someone has to referee.

FINRA's 2026 Annual Regulatory Oversight Report treats generative AI as a supervised technology, not a novelty — the same rigor firms apply to any critical system. FINRA's stated expectations: formal AI governance programs with clear ownership across business, compliance, technology, and risk; pre-approval of use cases; and human-in-the-loop validation for any customer-facing or decision-influencing output. The report specifically flags a new risk category: AI agents acting autonomously without human validation, or acting beyond a user's actual or intended scope and authority.

The Treasury Framework Firms Should Know About
The U.S. Treasury has published an "AI Lexicon" for shared vocabulary and a Financial Services AI Risk Management Framework — a version of the NIST AI RMF adapted specifically for financial services, built with more than 100 financial institutions. For firms trying to translate FINRA's expectations into an actual control framework, this Treasury document is the closest thing to an off-the-shelf answer available today.
Platform Signals This Week
Salesforce Agentforce disclosed $800M ARR (169% YoY) and is shipping Agentforce Help Agent with pay-per-resolution pricing — a billing model that itself needs an audit trail for FinServ deployers. Guggenheim's July 1 upgrade of Salesforce and ServiceNow to Buy signals institutional confidence that agentic platforms are additive, not just disruptive, to enterprise software economics. Neither upgrade addresses governance — that gap remains open.

Bottom line for FinServ leadership: Regulators are converging on the same vocabulary — governance, human-in-the-loop, documented model validation — whether the frame is FINRA, Treasury, or the EU AI Act's Annex IV technical documentation. Firms that build one control framework rather than three parallel compliance efforts will spend less and move faster through both US exam cycles and EU obligations.

The FDA says be flexible. Industry is reading it as be cautious. That gap has a cost.
NEW THIS WEEK: The Guidance Interpretation Gap
A former FDA AI regulator, now chief AI and regulatory strategy officer at Parexel, told STAT News on July 2 that the FDA's intent to be flexible on AI in drug development is "getting lost in translation" — industry is interpreting the guidance in the most conservative way possible to avoid risk. Separately, industry and academic stakeholders asked the FDA (as of July 1) to clarify objectives and governance for a proposed pilot evaluating AI in early-phase clinical trials, including specific metrics and international regulatory alignment.

The EMA and FDA have published 10 common principles for AI in drug development, intended to underpin future guidance on both sides of the Atlantic and support international standard-setting. This matters directly for the interpretation gap above: a shared principles document gives sponsors more confidence to act on the FDA's stated flexibility rather than defaulting to the most conservative reading.

EU AI Act and Clinical AI Systems — Still Live
Clinical decision support and patient risk stratification remain Annex III high-risk systems, but under the newly hardening Omnibus timeline, standalone high-risk obligations now land December 2, 2027 rather than August 2026. What does not move: Article 50 transparency disclosures for any GPAI model (Claude, GPT, Gemini) used in a clinical pathway, due August 2, 2026 regardless of the high-risk delay.

NVIDIA and Emerald AI announced a coalition this week with AES, Constellation, Invenergy, NextEra Energy, Nscale Energy & Power, and Vistra to build AI data centers designed to connect to the grid faster while operating as flexible energy assets that can support grid stability rather than just draining it. This reframes the AI-versus-energy competition from earlier in 2026 into something closer to a partnership model — at least for the utilities with a seat at this table.

PJM Interconnection, the largest US grid operator, now projects a six-gigawatt shortfall against its own reliability requirements in 2027. The bottleneck is not capital — it is physical supply chain: a five-year backlog on grid transformers means only 5 of the 12 gigawatts of announced US data center capacity are actually under construction. Williams' $5.1B portfolio, including modular gas-fired power plants sited directly at data centers, is one response; the NVIDIA/Emerald AI grid-asset coalition is another. Both point to the same conclusion: project siting is now decided by power availability, not latency.

Databricks Deepens Its NVIDIA Bet
Databricks (~$175B valuation) expanded its NVIDIA partnership this week, integrating NVIDIA's new Vera CPU directly into the Databricks AI Runtime and bringing serverless NVIDIA GPUs to Databricks Free Edition. NVIDIA claims up to 3x faster SQL queries and 80% faster agentic workload performance from the integration — figures worth validating against your own workload before committing infrastructure budget, but directionally consistent with the broader platform push into agentic data operations for manufacturing and energy sensor/SCADA data.

For energy and manufacturing leadership: The grid-as-asset model is new enough that most utilities and large industrial AI users have not evaluated whether it changes their own build-versus-buy power calculus. If your organization is planning AI infrastructure in a PJM territory or similar constrained grid, the sequencing question for Q3 is whether to pursue a flexible-asset arrangement now, before the coalition model matures and negotiating leverage shifts to the utilities.

The 2026 numbers are specific and worth reading carefully rather than reacting to. As of July 3, there have been 267 layoff events affecting 185,894 workers this year, an average of roughly 1,010 job losses per day. Of those events, 56% explicitly cite AI, automation, or machine learning — 150 companies, 156,270 workers. Oracle disclosed 21,000 layoffs over the trailing 12 months, about 13% of its workforce, attributed to AI adoption. Amazon cut 30,000 corporate roles across two rounds. Stanford HAI's 2026 AI Index recorded a nearly 20% drop in employment for software developers aged 22 to 25, while headcount for more experienced developers grew over the same period.

The Detail That Changes the Story: 77% Were Anticipatory
A significant share of AI-attributed layoffs happened before the technology had actually replaced the affected roles — these were restructuring decisions made in anticipation of AI capability, not a direct 1:1 substitution that already occurred. A separate finding reinforces the same picture: companies reporting high AI ROI were not disproportionately the same companies reporting AI-driven workforce reductions. The workforce and the productivity story are running on more separate tracks than the "AI took the jobs" headline suggests — early-career technical roles appear to be absorbing the disproportionate share of the disruption.
